Whether or not you "can tell" is she biologically male, it's obvious for her hair, makeup, and clothing she identifies as a woman. Misgendering is a crappy thing to do, and while I don't believe it should ever be a legal matter, I hope the train sends her an apology letter, and it would be nice if they included a return journey of her choice.

I kinda understand the guard a bit. When I worked in Asda and I was serving one person after the next I could sometimes misgender by total accident

Just watched the whole thing and honestly...big deal over nothing.
I fully support anyone's choice of course but she still has a very deep voice and a quite masculine face - I can totally understand how she could be misgendered just from a glimpse. Seems to be about money. |

As always it comes down to intent; if it's a genuine mistake or misunderstanding that's one thing. If it's being done deliberately or in a pointed way then that's another matter.

Even non-trans people get mis-gendered from time to time. It happens.
I had the misfortune of being mistaken for my mother's husband once (:umm2:) I didn't go on This Morning to cry discrimination. A mistake is a mistake. |
