I don't believe MPs are above the law but I think if I as a student did what he did and attacked 4 people causing mayhem and damage and injury then I doubt very much if I would have walked out of court on the day of sentencing.

Labour can only discipline him, expel him from the party and de-select him as they are doing, as their candidate.
They cannot though remove him as the duly elected MP, he could have changed parties mid Parliament and still remained an MP and now he got no custodial semtence it is unlikely he would be removed from being the MP until the next election unless he resigned as MP himself.

A fair few constituencies have MPs the bulk of its electorate dislike intensely but they cannot get rid of them and the Lib Dems did away with their idea of making it that constituents could force a recall of an MP so unless he goes voluntarily, Labour, the Govt even, nor anyone else can really force him to go until 2015 if he decides to see it through until then.
