People who are unknowingly filmed for sure are victims. If you know and consent to being filmed, please quit moaning, it's not the same. I think the law should be that if you knowingly take part in sex tape then you run the risk of leaks and footage falling into wrong hands. It's like letting go of a favorite balloon with jewellery attached into the air and then crying that someone nasty like Robert Mugabe or Vladimir Putin has it.
The point is that he wouldn't have expected anyone else to do anything with the video, because it isn't their property. It's against the law to steal someones property, regardless of whether it's a video or anything else. It might have been foolish of him to think it would stay private, but that doesn't change the law, or the fact that if it was stolen, then he is the victim of a crime.
