The point is that he wouldn't have expected anyone else to do anything with the video, because it isn't their property. It's against the law to steal someones property, regardless of whether it's a video or anything else. It might have been foolish of him to think it would stay private, but that doesn't change the law, or the fact that if it was stolen, then he is the victim of a crime.
