AN asylum seeker has blamed the "immorality" of Newcastle city centre for his sex attack on a "vulnerable" man.

A court heard this week Zain Osman - who fled his life as a shepherd in Sudan in the back of a lorry - left his victim traumatised.

When he came across his victim - with another man who ran away - in the early hours of the morning, Osman approached him and put his hand down his trousers.

The 25-year-old pulled his trousers down and pushed the 26-year-old's head towards his genitals, before pursuing him in a 20-minute attack.

He admitted the sexual assault in September last year, and has been jailed for 15 months at Newcastle Crown Court.

The prosecutor said Osman has no previous convictions in this country but added: "He is an asylum seeker from Sudan who entered the UK in a lorry with no passport so we can't say if he had any convictions outside this country."

Jamie Adams, defending, said: "All of the protagonists seem to be drunk and are out and about in an area which is known to have a reputation but that's not to say it's right, because, of course, it was not for the defendant not to have taken no for an answer.

"His behaviour was more out of clumsy drunken persistence than in any sense violent.

"He is an uneducated man, he was a shepherd in his own country, the Sudan.

"He had never experienced the kind of immorality he experienced in coming here and was evident in this particular area of Newcastle.

"But it was quite wrong to have made his advances when it was evident the man didn't want anything from him.

"He came from Sudan, where homosexuality is still a capital offence, although it's not always enforced. Alcohol is also a pretty serious offence for a Muslim in Sudan.

"This young man had not had any experience of either of those things until he came here. Sadly he started using alcohol.

"He lacked the kind of life experiences we know about in our more civilised community.

"He is awaiting a decision as to whether or not he can have asylum because of the experiences he had at home."

Prosecutor Robin Turton said the victim fell into a ditch as he tried to get away.

He added: "He tried to walk away but felt a bite from behind.

"He screamed and told him he was going home."

The victim had swelling and abrasions above his eye, bruising to his arm and chest, a grazed knee and bite marks to his back and shoulder blade.

Sentencing him, Judge Jeremy Freedman told Osman: "The fact you were drunk and that (the victim) was drunk does not provide you with any excuse, albeit it it may explain your behaviour in part.

"It's apparent from the CCTV that he was desperate to get away and becoming very upset.

"You would not take no for an answer."

The judge added: "I accept you are now very sorry for what you did and you are a naive uneducated gentleman.

"Nevertheless, you knew what you were doing was wrong and you must be punished."

As well as the prison sentence, Osman must sign the sex offenders register for 10 years and was made subject to a sexual harm prevention order for the same period.
