As Dave wants to walk, and he would probably have been the next HM up for eviction last Friday after Ben (number of votes). So let Ben swap for Dave.
Makes sense really.

They did this with Nikki and alot of people were pissed off and complained because those who voted to evict Nikki 'wasted their money'.

Dave wants to stay. He said he'd only walk if he feels his family aren't enjoying the experience (which they are). BB didn't give him the message from home, originally the task prize was a letter from home, by the time they changed it it was too late for Donna as she was travelling to london for the ignore task.

Thing is if Ben comes back he could win, and that would not be right.
Having said that though he would probably get nominated loads because the other housemates would feel he shouldn't be in there cos' he was evicted.

I was talking about the public, not the HMs. You're certainly a loyal friend. A much better friend than backbiting Dave was to Ben

Abhorsen,that is the way it would be justified,also it has to be remembered BEN only had 52% of the vote too,howevem, I still stand by the staement I made on another thread that I doubt BEN would want to go back in.
Johmm James would know BEN had been evicted with the most votes last week, he would pick a battle right off and rub BENS nose in that so I cannot see BEN wanting to go in on those terms either.
Like the good day or bad day option for an evicted housemate to give to a remaining housemate that was scrapped after about 3 weeks and maybe after the 2nd week it was done, I ahve hoped wek on week that the save and replace task would have got scrapped too,it didn't and BB manipulation of that with a rather easy task for Steve on it was the reason BEN went on friday, Steve was sure to go had he still been up.
I love your idea and its a valid one but I doubt BEN would want to return.

I think it would (if the series continued) be worth looking at this kind of scenario:
BB lets the public know, up front, that IF nominees survive but walk then the evicted is the 'replacement HM'.
There will be no such thing as 'New HMs' unless absolutely necessary.
OK.
Maybe people knowing the risk up front changes things. Maybe people getting a 'credit' back puts more accountability on BB to MAKE CERTAIN they don't allow anyone to leave?
I dunno.. this is just thinking-out-loud but it might be something to look at. Something to satisfy either side of things.
Remember.. you can also have an angry 'money complaint' when you voted and voted (paid and paid) only to see someone walk a few days later,
and,
had you known they would go.. you would NOT have voted for x or y a z.
Anyways.. one thing we all agree on - walkers (especially having just been up and survived at someones expense) these are really annoying and ruin the program.

ok then..... how bout we bring him back, but he cant win, then no one has wasted the money, and he goes out via the diary room on final night, then we get the entertainment factor back in the house.
Or let him interview all the remaining evictees, that would be SOOOOO hilarious.?

This show has no integrity and people "waste" their money any time they vote for a person that isn't evicted, so I've never understood that argument.
On the other hand, the audience is so stupid for evicting Ben I feel they don't deserve him. Let him be.
