Many seem to to think Josie has it in the bag to be the winner!! but what if she doesn't want to go back in? she may want to meet up with John James as soon as.
I wonder if this was to happen (Josie win, but not want to be in UBB) would the runner up get the chance to go in?.
Mario, JJ, Andrew would all be definatly up for going back in if the won, Dave I imagine too think he poss suprise us and could say he want see his family now.

They'd probably just go along the line from second place onwards until they found someone wanting to go in, sadly.
They should just send Sam in.

I'm hoping Davina will do the winners interview in the house and not let them out so they don't get a choice :)

I would imagine that there would be a clause in the contract saying if you win, you are obliged to go in. Sometimes people have to do stuff they don't want to do because they contractually obligated.

I don't think they can be contractually obliged to do UBB if they weren't informed about it until after they entered the BB house. We know they get a choice though so i'm guessing BB will have measures in place in case Josie doesn't do it (*crosses fingers for Sam*).

Maybe a public vote to choose who goes in? That's Friday's live show sorted, if that's the case.

they were all contracted to stay for 2 more weeks so dave will just have to stay when he wins tonight:dance::xyxwave::dance:

Be funny if bb's back up to this was open phone lines for all previous HM that would like to be voted to go in, I doubt it as where would time slot be.
I read another thread after I sterted this that may suggest a possible dilemma.

Yeah, you could be right, but I'm wondering if they can circumnavigate it by putting in one of those cover-all kind of phrases. You know, the "and any other duties as directed" kind of clause. I would really like to see one of their contracts, just for my own interest.
Does anyone think Josie won't do it?

Yeah, good point about the two weeks.
Not so sure Dave will be staying though. But I wouldn't mind too much if he did.

I'm sure they are contractually tied to big brother for 13 weeks so if anyone was to walk, they would have the same rights as anyone that walks in the first week (NO PRIZE FUND).

I dont mind if dave or Josie wins.
just a pity she got the fun sucked out her by jj1, altho its been great to see the old josie back since Friday.
Tbh, the only chance dave really has is if the Josie fans think she has it in teh bag and dont bother to waste their cash:joker:

I don't believe she will have an option, her original contract will be for the show to finish on 12th Sep, just because they have changed the name of the show isn't going to be a "get out free to shack up with JohnJames" clause.

Well she can't be forced into it evidently as Davina said the winner will have the choice to go back in or not and considering it's recognised as something different to BB11 who knows if the old contract clauses will apply?
I don't think she'll go in at all and I don't think BB would elect to send in any of the finalists either.

I wasn't a massive Josie fan from the start, but I do think I missed getting to know who she really was because of John James. I don't wish her ill, and I hope she finds herself a real man when she comes out.

I think she'll snap their hand off.
As someone else said earlier in this thread (Margeryfan?) they'd probably have the choice not to go in, but lose the prize fund. I hope that's so. Sometimes people have to do stuff they don't want to do.
Yeah, it's possible that they are obligated by contract to stay an extra two weeks
I think Josie will be happy to do it out of gratefullness to Big Brother and the people who voted for her, although she has been seeming pretty excited at the prospect of returning to the outside world tonight. They all think Ultimate BB starts on friday dont they?

I don't think they'll lose the prize fund as the show IS something different to BB11 and that's not really a choice if that's the case that they lose the prize money.
If that was the case then Josie would have a strong lawsuit on her hands against Endemol. Davina's basically said that the winner will come out, get their prize money and have their interview and moment before being asked if they want to go back in so UBB is obviously optional otherwise they'd withdraw the prize under false pretences by acting as though UBB is a choice when it's not.
I would imagine that there would be a clause in the contract saying if you win, you are obliged to go in. Sometimes people have to do stuff they don't want to do because they contractually obligated.
It says on the c4 website the winner will be given the opportunity to take part.

Does she even leave the house?
I'm sure I read somewhere that davina was going IN to interview the winner.

No Josie's definitely gonna come out and 'have her moment' as Davina put it.

They originally said that the winner would not leave the house.
Recent forum talk and I think something that Davina said was that they would leave and be interviewed before going back in.
