Now that Josie has wasted her chance it's not fair on Dave that he missed out on UBB as he was runner up.

As Dave is runner up he should go in to replace Josie. There should be a HM from BB11 and the only one entitled to go in to replace Josie is Dave as he was runner up in the final.

Exactly. Sabrewulf is right. When deciding who would go in from BB11 the only consideration was who was first, therefore after she's gone the runner up should go into the house.
