Ok so heres todays scenario see if you can advise

we have various contracts forvarious bus/minibus/taxi drivers

so we got a new lady on for working day shifts.8 till 4pm...now phone work in the day is slow in this part of wales....so we rely on contracts....so we figured if we gave her a contract she could cover calls between contract

the trouble is the 3 day contract we had for her , has been covered for the past few months by an outside driver who works for herself, we paid her a fixed rate for each contract day worked.

so we had to stop giving it to that outside driver and give it to our new driver, to ensure she gets a basic wage.

the outside driver had been very reliable and done a great job, she was very upset as she had got used to this contract and of course used to the income from it in a very tough economic climate

its £120 a week for 3 days contract , but thats a lot in the midweek here as its quiet.

so was I obliged to keep giving this contract to this outside driver? was I wrong to give it back to one of our own drivers? she only had a weeks notice?

no, it was just a sort of week by week thing, she clearly got used to it, the client , the payments and it helped me keep the contract covered until i got an extra day driver in one of my vehicles.

You have no obligation to her to give her any notice...I can understand her being upset in these tough times but you have to do what is right for your business...

You're a business, not a charity. The fact she got used to it doesn't negate the fact that you had no contract with her.
