As a nurse, you are the last person to see Mr Smith before he dies in hospital. You believe that he became mentally incompetent in the last few hours and in that time he has rewritten his will. In the new will he viciously attacks each member of his adopted family and reveals that he actually was born a woman. He then cuts every family member out of the will leaving his fortune to a Psychic Chatline. Mr Smith asked you to make sure that the new will gets to his lawyer. Knowing that the document will most likely be thrown out of court but not before the damage to Mr Smith's family is done, do you carry out his last request?

I don't think it would be valid, firstly you are meant to be of sound mind, and secondly I think I has to be witnessed as such.

I would do as he wished but when handing it over I would explain that imo I didn't think he was of sound mind when writing it

Pass his request on. However misguided he may be, that was his dying wish, and not passing that on is almost inadvertently stealing from him.

As a nurse, you have a duty of care to the patient, not to your own beliefs and prejudices - and I absolutely despise psychics.

Who witnessed the will? If I bin it, I will be committing an offence, the witnesses will testify that the will exists and as I'm the last one to see the deceased alive, it's probably me who took it. Unless I kill the witnesses too. Hmmm... this is getting complicated. Maybe I'll buy shares in the psychic chatline.

Yes I agree with this. The nurse's job is to provide care, at most she should inform whoever she's passing it onto that in her opinion the will was not written by someone in full control of their mental capacities and that it would be for the best if the family were not made aware of the contents, but that's it.

I would honour his last wishes and hand the will to his solicitor as he asked me to. For me,I don't have a choice really if he trusted that to me as his last wishes.

There would also have to be a clinical diagnosing of him being mentally incompetent too. So in the absence of that,other than handing the will over as he directed,I would be unable to substantaite a claim he was mentally incompetent.

Hand it over. His wishes are nothing to do with the nurse. The miserable sod didn't leave her anything I see,hand it over love!
