It's the charge that's specifying the age range "13 to 17", i.e. to differentiate from 18+ (an adult) and 12 or under (a child).

The boy was 16, not 13. If she wasn't his teacher, it would be legal... although, still pretty weird... but anyway. The crime she is guilty of is abusing a position of trust as a teacher; which, YES, is bad and something that she deserves to be charged for.

However, because of the ambiguous way the article is written, she will probably end up branded as a "paedo" or similar... which is just bull****.

What's the issue? They are both of age and both consenting. If this woman wasn't a teacher no one - other than those who strangely have issues with age gaps - would care. So why is it any different just because she's a teacher? I actually think it's both incredibly patronising and contradictory that on the one hand there's this assumption that age 16 people are suddenly capable of giving consent and being in control of their own body, but on the other hand if it's their teacher they're being used and abused :shrug: perhaps someone who is of age is perfectly capable of understanding what their relationship with their teacher is but is still happy enough to consent?

I'm not saying it isn't, just that its a very different story still (with very different motivations) if he HAD been 13... it's not an irrelevant detail - an adult being attracted to a 16 year old is at least biologically not that strange. An adult being attracted to a 13 year old has some serious problems. In other words, with a 16 year old it's an abuse of power / trust issue - with a 13 year old it's a much deeper issue.

On the other hand, I do agree with Jack that there's a strange logic at play with these cases... which is; is a 16 year old mature enough to give full and informed consent, or not? On the one hand, legally, we say they are "in most situations"... but then on the other, we're saying that they could be controlled / manipulated by a person in a position of power, rendering their consent void. If the latter is true, then it can only be the case that 16 year olds should NOT be considered capable of full consent?

I personally am fully aware that many 16 year olds are far too naive and vulnerable to really be considered capable of full consent to sex with a "proper" adult. I've always advocated a tiered system of age differences to cut some of the anomalies out of the law (35 year olds having sex with 16 year olds being totally fine, while a 16-and-one-month year old could be charged for having sex with their 15-and-11-months year old girlfriend)...

Anyway, it goes like this:

13 and under - no consent

14 - not illegal with another 14 year old or a 15 year old (but should not be encouraged)

15 - as above with 14 year old, has full consent with 15-16 year olds

16 - Full consent with anyone aged between 15 and 21

17 - Full consent with anyone aged between 16 and 21

18-19-20-21 - Full consent with anyone aged 16 or over (up to any age)

22+ - Full consent with anyone aged 18 or over (up to any age)



...OK so you'd need to bust out the rule book before sex, but I think it makes thing morally much better. 14 the absolute legal baseline but only with another roughly the same age, a bit more leeway once you hit 16/17 allowing up to 21 taking "real adults" (and notably, teachers) out of the equation, and then full consent moving up to 18. IMO, at 18, consent should genuinely be FULL, i.e. if an 18 year old is still at school and wants to have sex with a teacher, that is their business. The only problem would be if bribery, blackmail or coercion was involved, but that can happen at ANY age (company bosses with young adult staff members, etc.) and is a form of rape so age of consent isn't the issue.

I have a 16 year old daughter, she's doing exams etc at the moment, I'm worried about boys her own age, to actually have to send her to school and worry about a full grown adult with power over her also would just be horrific. I'd probably end up sending her to a school with no male teachers if it were perfectly fine for full grown adults in a position of power to be able to pursue school kids in a sexual way

I agree but this is what makes me wonder about the age of consent, full stop. If kids at 16 aren't capable of protecting themselves in some situations then, surely, the same applies in every situation be it teachers or not - and therefore, I'm dubious about it being legal for teens to consent with full adults at all.

Then again, I have to wonder... Will you feel any differently when your daughter is 18 compared to 16? I doubt it's any different for a parent. My wife's younger sister is 20 and she STILL seems very naive to be honest - and this is a girl who was drinking / smoking / having sex at 14 and ran away to live with us for 4 months... Not someone who was wrapped in cotton wool.

Not sure what my point is there really. Just that 18 year olds can still find themselves in these situations with people who have authority of some sort or other over them. So I guess the important part is making sure young people are aware and prepared for those sorts of situations in general?

I know this is a jokey post but it's right as well and what if the teacher and student had a falling out or the student didn't want to be involved with the teacher anymore? The teacher is in charge of that student in class, they could make their life hell as well

I've never had kids of my own either but I'm with Niamh 100%. Teachers are in a position of trust in any case and it's not as if being 16 makes you magically develop adult maturity. I wouldn't want my teenage kid being taken advantage of by someone who's literally paid to know better.
