Ministers should set aside the European Convention on Human Rights (ECHR) and deport foreign criminals, a Labour MP has said.

Jonathan Brash, the MP for Hartlepool, said the Government should exercise its “perfectly legitimate” right to deport criminals by saying ECHR Article 8 rights to a family life do not apply in such cases.

He is thought to be the first Labour MP to publicly declare that the Government should ignore the ECHR in order to return convicted foreign criminals back to their home countries.

Many have used (exploited) Article 8 of the ECHR, which protects the right to respect for private and family life.

In principle I think countries should deal with their own criminals. I have some hesitance if deporting is effectively a death sentence, mostly because it'll become a slippery slope argument - i.e. if we'll deport knowing a death sentence is likely, why not just have our own death sentence.

Not here for any hypocrisy on this sort of policy. If we're going to deport criminals to their country of origin, then we have to accept British criminals detained abroad to be sent back to the UK. Which includes for example, Shamima Begum. But we already know how many TiBBers feel about that argument, from multiple threads.

I can see there being plenty of "We don't want your criminals but we don't want you to send us ours!" with very little self-awareness of the entitlement involved in that.

i think in the UK it's just a method for lawyers to make more money. There would be years of appeals for each case and the cost is all going in one direction

Yep exactly. I also agree that criminals should be deported but fair is fair.

labour won't come out of the ECHR, having been very vocal in criticizing the tories for making moves. However this is "new" labour, i suppose anything is possible :laugh:

In 2023 a Gambian man who raped a woman at knifepoint was allowed to
remain in the UK. He had arrived on a visitor visa in 2007 and spent the next
15 years dealing drugs in Edinburgh. Despite laws that state foreign nationals
convicted in our courts should be deported, he successfully argued he should be
allowed to stay on human rights grounds. A tribunal found that, if returned to
his home country, he would ‘experience genuine difficulties being able to access
a regular supply of his necessary medications’. He would also face a ‘real risk
of social -isolation and stigmatisation’ given that he’s a rapist.

As you'll know Livia the money "generated" by cases involving the ECHR are an absolute pittance when compared to areas like corporate law, real eastate law, intellectual property law and litigation ... so no it's obviously not the truth. In fact it's a nonsensical claim. Because it's simply not where the money is. It is, in fact, a piss poor example of a revenue stream for the legal trade.

The only time we generally hear about the ECHR is when it's stopping migrants from being deported - and that may well be selective reporting, especially from certain tabloids who might run certain polls.
