It's rather easy really to decide between the two of them. Jen was the one that milked the situation for all it was worth because she was enjoying all the attention. If she had accepted Rex's apology and not gone on about it then spitgate wouldn't have happened.

Dale was just hot headed and stupid.

I found it a bit weird to watch how Dale said he 'couldn't cope' if Jen left. He never struck me as that sort of character to begin with.

Dale for me, as he was the real aggressor.
It was he who dragged a man back to oppologise without having the sense to realise he already had TWICE.
It was he who then called the man a coward for doing what he had insisted he do AGAIN.
Dumb enough not to realise his 'girl friend' had accepted oppology number 2, arrogant ignorant enough not to listen to the man who told him he had oppologised twice already, and cowardly to attack a man once he'd led him into his own protective group.
He makes Jen look acceptable, and that ist easy since 'spit gate' kicked off
