View Full Version : Another nail in Youtube's coffin: Music videos pulled in Germany

Following Warner's decision to pull its premium music videos from video-hosting site YouTube, the distributor has decided that enough is enough and is removing any amateur footage that features its music.

This is not the first time that amateur movies featuring copyrighted tracks have disappeared or – even worse – turned mute, but Warner is now recalling 'tens of thousands of tracks', according to a lawyer from the Electric Frontier Foundation (EFF).

Sharing the frustration

Warner spokesperson Will Tanous has defended the move, saying: "We and our artists share the user community's frustration when content is unavailable.

"YouTube generates revenues from content posted by fans, which typically requires licenses from rights holders. Under the current process, we make YouTube aware of WMG content. Their content ID tool then takes down all unlicensed tracks, regardless of how they are used."

When Warner first announced its intention to pull content from the site back in December, it assured YouTube users it was a temporary measure and that it was "working actively to find a resolution with YouTube that would enable the return of our artists' content to the site."

With this new development, it looks like an agreement is still a long way from being reached.

Nah I can see it being a brand new website... same idea but with a new cool look, and some new feature. Like... live broadcasting or something.

The UK is one of its main audiences...and we havent been treated well by them...people will soon realise there is other websites

At this rate, YouTube will have precious little music left. After blocking all music to UK users while demanding lower PRS fees, the video site is now yanking tunes in Germany, after the expiration of its contract with local royalty collector GEMA on Thursday.

The difference? GEMA's rates are 50 times more than even PRS', GooTube EMEA head Patrick Walker told Der Spiegel: "It's unprecedented in the history of music video streaming." While PRS charges £0.0022 per track, GEMA's standard on-demand music rate is €0.12 (£0.11) for every song up to five minutes, and more for longer tracks and those with ads. That seems to be at least a €120,000 bill for every million music streams.

GEMA tells Der Spiegel it had, in fact, offered YouTube a rate of just €0.01 per track - but says YouTube is not ready to give it the transparency it wants, in return, on its required repertoire. So it looks like the fragmentation of European copyright collection is scuppering this relationship, too. GEMA chief executive Harald Heker, in a release, said: "It is a fundamental clash between GEMA and Google/YouTube from. Other European companies, which are also use musical rights, are in the same difficult situation. GEMA represents 60,000 composers, authors and music publishers and the rights of more than a million copyright owners internationally whose works are used in Germany.

imeem has a few artists who opt out of having whole songs on there. I've been a member there for years. Coldplay were one of the first ones to take legal action and they only feature 30 second clips of their tracks. There were others, but I can't recall off the top of my head.

Youtube will tank because of this. It's a sad day for skint music fans. :(
