Can he pardon himself? I thought it was still quite a grey area because its completely unprecedented.

It's not decided either way. Even constitutional law scholars disagree on whether or not Trump has the power to self pardon.

there is nothing that excludes him from pardoning himself and there is no previous reference to rely on. He will get away with all the federal stuff, im sure of it. It will require state action to prosecute him

I was wondering what the 25th Amendment was.

Quote:

.....Discussions are focusing on the 25th Amendment of the US Constitution, which allows for a transfer of power from the president to the vice-president, either temporarily or permanently.

How would this work?
The 25th Amendment allows the vice-president to become acting president when a president is unable to continue his duties, if for example, he or she becomes incapacitated due to a physical or mental illness.

The part of the amendment being discussed is section four, which allows the vice-president and a majority of the cabinet to declare President Trump unable to perform his duties.

They would need to sign a letter to the speakers of the Houses of Representatives and the Senate declaring the president is unfit to govern or incapable "of discharging the powers and duties of his office". At this point, Vice-President Mike Pence would automatically take over.

The president is given the chance to offer a written response, and if he contests the finding, then it falls on Congress to decide. Any vote in the Senate and House of Representatives ordering the president's removal requires a two-thirds majority.

Until the issue is resolved, the vice-president would act as president.....

Chuck Schumer (who is one of the high ups) has called for the 25th amendment to be invoked and if it isn't then the Congress should reconvene immediately to Impeach Trump, Nancy Pelosi has called a 1pm presser

Tbf some of the Trump supporters were planning on attacking Pence, so he hasn't really got anything to lose.

Plus he might just respect democracy.

Pence doesn't become a decent human being for performing his constitutional duty on one occasion. He has enabled Trump and lied to the american people for 4 years

Crimson Dynamo 07-01-2021 06:44 PM

the hard left have spent 4 years trying to get rid of Trump so this 2 week window seems ambitious..

Would have been a start at least.

There’s two weeks left of his stay, have they seriously not got anything else to do? They could be spending this time fighting COViD, writing policies getting things ready for the new presidency, speaking to the public.

Because they're in a state of panic, Trump has them by the short and curlies.

They're trying to do those things but Trump is not co-operating with the transition process. Dont know how you all missed this because its been news since the election.

Trump put out a statement last night saying they'll be a peaceful transition. He's always said there will be. Doesn't mean he has to conceded yet.

How can it be peaceful if he doesn't concede?

Trump has incited terrorism in the country tbf, it's not something that the law can ignore so easily.
