It's a foolish lawsuit on M&S' part really. Aldi is pretty much the most popular supermarket, and targetting a product on their shelves isn't going to magically make people buy it from M&S instead, it'll just stir up anti-M&S sentiment. Aldi's pretty much played a blinder on the social media front since they've successfully set up M&S as the villains of the story and that will only damage M&S while driving sales of Aldi's cake because of the attention on it.
