I don’t think it’s actually legal, it’s just not illegal, it’s one of those things that, most people should know is not okay... although it should definitely actually be illegal

Rape is always illegal, the problem seems to be that consensual sex between an officer and a detainee in those states is not illegal - so an officer could rape a detainee and claim it was consensual activity and, in all likelihood, avoid being charged.

In the "green" states it's flat out illegal whether there's consent or not (as it obviously should be ffs) and so, if sexual activity took place, the detaining officer would be automatically guilty without the possibility of making false claims of consent.

Their commander in chief is Trump, who is very clear in his support for the police, thus the US military defending civilians from the police represents breaking the chain of command (because Trump is at the top of that chain) and could effectively be considered desertion or even an attempt at a full on coup d'etat (knowing Trump).

Really? That seems really murky territory to me. It should be against the rules as those guards hold a position of power over those women. . .I'm sure lots of "not rapes" happen :/

agree its a very odd law, why would you want to have consensual sex with a prisoner, surely that is a conflict as well if the case goes to trial

Absolutely. It's a position of trust, and a position of power. It shouldn't be legal anywhere. I think where some got confused is that as you say, "not rapes" could happen and the guard could say it wasn't rape - just like what happens to some ordinary people...
