Locals said his charred remains were tied to the lamppost when he was found shortly before 5am by two members of the public at Caponacre Industrial Estate.

Strathclyde Police confirmed that the body bore scorch marks and horrific injuries which were making a positive identification difficult.

The man leading the investigation, Detective Inspector John Hogg, said: "We are still trying to identify the man and what happened to him although we know he did suffer horrible injuries.

"He is described as white, 20-30 years of age and of stocky build.

"But we have no further details at this time and have not yet identified him.

"The industrial estate is out of the way from the main routes but the units are used over the weekend, so there may be people about who saw something that may help our inquiries.

"There is also a housing estate nearby so again, we are asking local people if they saw anyone acting suspiciously."

One local resident told the Sunday Mail: "There was a disturbance last night in the town near the industrial estate involving young people and this could be linked to this man's death.

"We have been told that the victim was tied to a lamppost and then they tried to set him on fire.

"Some people are saying that they managed to burn him but not completely - and that he may have been beaten to death."

Friends on popular former Cumnock Academy pupil Stuart's Facebook page left messages mourning his loss last night.

Sarah Tomlin wrote: "R.I.P Stuart. You were one of the lovliest people I ever had the chance of knowing. You will be sadly missed.

"Hope they catch who did this."

Whoever did this must be incredibly disturbed to kill someone in such a gruesome way. I'm guessing he got himself into trouble of some sort since it's quite an elaborate way to kill someone if it was just a matter of him being in the wrong place at the wrong time since you'd need to have the tools used at hand. I'm guessing it was a pre-meditated murder rather then a spur of the moment type thing.

Hopefully whoever committed this act will be brought to Justice.

Now... I am not insinuating anything here, at all - but that particular area and the surrounding area in Ayrshire has serious drug issues - I mean heavy duty, serious ones. It could be linked to that - whether he be involved or not - but regardless, it's a hell of a way to deal with someone.

It's not any worse than other places to be honest. And, Cumnock is a small town, so it doesn't have the issues you see in cities. I doubt this is drug-related. I think it's a hate-crime. I don't think it's a co-incidence that he's gay.

I heard that 4 girls were lifted for it.. but that could just be the usual local gossip. :/

Really.... I beg to differ. How many small Scottish towns have 3 people living in or around Cumnock, that were connected and jailed for their part in a £20million cocaine import about 8 years ago...... not many that I'm aware of.

yes, I do base it on that - on the area...not the town alone.

And you have no idea where I have lived... or for how long, or how much I know about who was involved, to what extent etc.

I still would not be surprised if this poor guy's death was drug related. Not saying it was right, but that's pretty much my opinion.

Something similar happened to a guy a few of my friends knew about 3 years ago. Tied him to a fence, made him drink petrol then set him on fire. Absolutely sickening how anyone can consciously do something like that

This is making international headlines. The police aren't saying it's a hate-crime, but it really looks that way, and a lot of the LGBT news sites have picked up on the story too. His name is trending in the UK on twitter today.

It makes me feel physically sick that something so evil has happened in the place I live.

“I wasn’t there. I was staying at my girlfriend’s.

“I’m nothing to do with any of this. They’ve come and taken my DNA but that’s what murder cops do when something like this happens.”

Several other members of the Esquierdo family have been quizzed by cops.

Dad Anthony, 48, of Logan, near Cumnock, confirmed he had been spoken to.

Strathclyde Police, who did not wish to comment yesterday, have formally confirmed that they believe Mr Esquierdo was being arrested for no good reason. Smith, 37, who initially denied attacking Mr Esquierdo, earlier pled guilty to assault.

He had seized hold of his victim by the arms and body, handcuffed him, and forced his face repeatedly to the ground. He also admitted spraying CS gas.

Sheriff John Montgomery, sentencing, said: "There can be no doubt that this crime involved abuse of the power which society invested in you as a police officer."

The incident took place on February 4, 2006, in Cumnock, Ayrshire, as Mr Esquierdo, at the time the president of local junior football side Lugar Boswell Thistle, and his family were driving to a game.

The police have since apologised unreservedly for Smith's "reprehensible" behaviour.

However, Smith's defence agent, Paul McBride QC, argued in mitigation yesterday that the former constable had suffered more than Mr Esquierdo as a result of their "struggle".

"He has lost his career. He came off worse in terms of physical injuries than the complainer," Mr McBride said. "He accepts his actions when he carried out the arrest fell short of the appropriate professional standards that would be required."

Mr McBride stressed Smith's previous good record as both a police officer for four years and as a retained firefighter, a position he still has. Smith had previously been commended for his bravery. He is now working in his family's motor trade business.

Mr Esquierdo said: "I am just happy that this has been resolved."
