What a bunch of assholes. Many people have pointed out that Dani California sounds a lot like Tom Petty's Last dance with Mary Jane but when Petty was asked about it he recognised the similarities but didnt bother to sue. Decide for yourself.

Frm the Dani California wiki page.

Quote:

Shortly after its release, the originality of the song was questioned on the Dan Gaffney Morning Show on Delaware based news/talk radio station WGMD 92.7 FM.[7] Two of the station's talk show hosts Dan Gaffney and Jared Morris alleged that the Red Hot Chili Peppers had plagiarized Tom Petty and the Heartbreakers' 1993 hit "Mary Jane's Last Dance". To demonstrate, they presented audio snippets of both songs, both side by side and simultaneously (i.e. on top of each other) several times. They stated that the chord progression, key, and the lyrical theme of the songs (both produced by Rick Rubin) showed "startling similarities" and urged listeners to "decide for themselves."[7]

Although the chord progressions sound similar, they do in fact differ as "Mary Jane's Last Dance" follows "Am, G, D, Am" (A Dorian mode), while "Dani California" follows "Am, G, Dm, Am" (A minor). University of Chicago musicologist Travis Jackson said the songs' chord progressions were similar, but were a "pretty standard groove" in music and not necessarily evidence of copying.[8]

In an interview with Rolling Stone magazine, Petty denied rumors that he planned to sue the Chili Peppers and said, "I seriously doubt that there is any negative intent there. And a lot of rock & roll songs sound alike." Petty went on to say that The Strokes admitted that they took Chuck Berry's riff for "American Girl" and used it in their song "Last Nite", and even openly admitted it.[9]

It will fail 100%

Nothing will happen.
And lol at them doing it before..

setanta 16-10-2010 11:51 AM

I'd forgotten how irritating her voice is.

GiRTh 16-10-2010 11:53 AM

I like the quote from Petty. 'A lot of Rock and Roll songs sound alike'. Spot on. Too many musicians act like precious arseholes when it comes to their own work.

BB_Eye 16-10-2010 01:08 PM

Can you imagine if the families of every blues musician from the mid-20th century took out lawsuits against everybody who employed the same chord progressions? We'd never hear the end of it.

I think lawsuits should only be carried out in extreme cases, such as when the British post-punk band Wire sued britpop band Elastica... which was thoroughly deserved.

BB_Eye 16-10-2010 01:21 PM

And that she's listened to Under the Bridge the previous day. They got George Harrison in his famous plagiarism suit over My Sweet Lord due to the fact that he knew the song He's so fine by the Chiffons.

M X 16-10-2010 01:31 PM

Meh, they are sort of similar. But Diana's is better.

Jordan. 16-10-2010 02:30 PM

What an awful song, she deserves suing for putting everyones ears through that.

Z 16-10-2010 03:07 PM

I'd forgotten how annoying I find her voice, I managed to pretty much completely avoid listening to her music when it hit the charts however many months ago. She's blatantly ripped them off and stupidly admitted to it; they'll take her to the cleaners and spend the money on party drugs. Welcome to fame Diana!

They can like whatever they want it just proves they dont know what the hell they're talking about.

InOne 16-10-2010 04:06 PM

I guess it is a bit harsh, she is only some crappy X Factor reject, not exactly a big threat to them.

SoBig 16-10-2010 04:23 PM

She is so stupid. She knew that she sampled their song, yet she didn't ask for their permission to use it? She deserves to get sued.

Jords 16-10-2010 10:49 PM

oops!
And I like both songs tbh.

Lucy. 16-10-2010 10:57 PM

Whoever signed Diana were the ruin of her, she was so unique, her no shoes and messy hair were her symbol now she's some barbie in heels :nono: I don't think Chilli Peppers should stress, fair enough the chorus for like 4 seconds sounds very similar but other than that not really. Besides hers is rubbish and theirs is epic.
