Trades Description Act
 
Would the TD Act apply to the following situation.?

In a cafe, you order burger and chips and ask for tomato sauce. The waitress brings a Heinz tomato ketchup bottle to the table and you just know straight off that it isn't Heinz.

It's not too bad, tastes ok, so I'm reluctant to say anything.

Ever been in a similar situation?

What did or would you do?

Nah, they don't have to provide a certain brand of sauce and you don't pay for it anyway

Happens all the time in bars. Trying to pass cheap crap off as coca cola/pepsi. As if you cant tell the difference :rolleyes:

Yes but you pay for that, you don't pay for sauce in a restaurant.

Don't really see the problem as long as it tastes fine tbh, it might not actually be Heinz but not like they're obliged to provide it or anything

No, you're missing the point (except Vicky, :D) it's rather dishonest to put it into a heinz ketchup bottle, it's not relevant that I didn't pay for it, I never said anything anyway, not worth making a fuss over even if it is crafty :p but I certainly would have done if for example they had served me cheap cola and advertised it on the menu as Coca Cola.

I just think it's naughty. If they'd brought it in a plain container I wouldn't have given it a second thought.

Well you would have taken the sauce whether it was in a heinz bottle or one of those plastic no labeled ones, so I don't see the issue really, it's not like anyone is going to not use it for not being a certain brand :laugh:

...I think that what Niamh's trying to say though Kate is that ketchup isn't a menu item...so they can serve what they like in whatever container they want to....

While you're not paying for it, I feel sure Heinz would have something to say about them passing off a generic sauce for their ketchup. Write to Heinz and complain Kate, they may send you free stuff!

lol I'm just saying, it's something free that they give you so you can't really complain about it. They probably get big tubs of it and just put into Heinz bottles cos they're handier for giving to customers

Remember, they have gone to the trouble of decanting it from it's original bog standard tub, into a heinz bottle. :nono:

Yeah because they're probably huge and not practical for bringing to peoples tables

The free sauce that is factored in to the cost of your meal, and where they are breaking the law by putting it into the bottle of a trademarked company.

There is no such thing as a free condiment.
