He was pulling out into traffic with right of way and his car was hit side-on, which means that it was his responsibility by default (as he was the one breaking the flow of traffic). That is unless the oncoming car was speeding - which seems very unlikely, as if they were
someone would be dead or seriously injured.
It is possible that he was blinded by the sun but that doesn't negate him being at fault, as the rule is always "if you can't see that the road is clear, assume that it isn't".
