It doesn't really have the same right to it, does it?
I did always like the idea that 007 is just a designation and James Bond is not the operative's real name... like he might be Jim Smith, but when he becomes a 00 spy he gets a new identity with the name James Bond so that his friends/family are protected.
That way you can have one Bond pass the title (both 007 and James Bond) to the next actor when a Bond dies or retires, and still keep an over-arcing storyline running through the films, and keep some of the same actors if you want (your M's, Q's, etc.). Also means the new Bond doesn't have to look anything like the last, including race etc, as it's quite a generic name.
