Been meaning to update on this, though we could prove payments, the accountant said he had many cases like ours and once HMRC started queries like this they would just rumble on and keep the case open for years and we would just be racking up accountancy fees, so his advice was to accept what they had refunded even though it was wrong and to close the case ....fuming...but we had no choice
