Pedestrians aren't the one who is charge of driving the vehicle that can kill. That's the difference. The onus is on the driver to be paying attention and to be able to 'read the road /situation'.
It's actually vital for the driver to look ALL THE TIME when they are driving: not only
'before driving'.
Of course emergency situations happen: that is not what you posted though: what you put up sounds as though you are describing a very regular situation. (below)
