I think going after the uploaders of copyrighted material e.g. films, books, games are the ones who should face charges, and they deserve punishment.

But, think of it like this:

Minecraft is a indie game that rose to fame because people made Youtube videos, Tweeted about it, blogged about it on tumblr, talked and posted pictures of it on forums. Now consider this, all those methods of promotion are banned, Minecraft, possibly the biggest most revolutionary game in recent years would have simply been ignored. The developers don't benefit, they lose out, there's no websites to promote their games because they're illegal under ACTA.
