Why is spoiler up for eviction?

Pav and Zoe were the 2 housemates with the most nominations.
Why is Chris up for eviction?
"The 2 or more housemates with most nominations face eviction".
If it is not that, then what is it?
It cannot be 2 nominations and you're up because there have been previous rounds where a housemate has got 2 votes and NOT gone up.
BB just making it up as they go along?
