The biggest backstabbing villain at "Big Brother" isn't Ariana Grande's brother, Frankie -- or any of the other contestants -- it's the CBS honchos who run the voting ... according to a new lawsuit.

A guy named Edwin Lyda claims he invented the system for text message voting and says he holds the patents to that system. He claims CBS jacked his invention and uses it each week on BB.

On the show, viewers vote in various ways -- by telephone, online, with a phone app or text messaging. The votes don't determine who stays or goes ... it's for things like who should win bonus prizes or who should get special perks in the house.

Lyda says his system for text voting is a big part of the show ... he wants a court to decide how much of BB's millions he's entitled to get ... then again, he could get nothing.

We called CBS for comment ... so far no word back.

Is the phone text voting really that much of a 'system' that you could actually patent it ?

In previous years didn't they vote on even more game-crucial stuff than this year's 'Team Awful America!' task voting for stuff like what the have-nots would eat that week (wow....soooooo exciting!) ? It used to amaze me that people could even give a sh*t about that enough to spend cash on voting for it!!!!

When the seasons going like it is now the viewers really should get to vote on something that actually effects the game!

I really think (and i've said this in previous seasons too!!!) that they should implement a rule to stop them being able to put the same people on the block week after week! It would force them to play a more entertaining game (like the Dickanators having to put each other up and ruffle feathers!) and it would be much fairer, especially for people like Victoria and Donnie!!!
