Hmmm...I reckon, if it was Rees-Mogg, or Boris, sipping a cocktail on the underground, someone selling the picture would be much more acceptable.

I'm yet to see or hear any evidence that the picture was sold.

The rules about images are as much the law as the rules about alcohol. So you're not only picking and choosing the people the rules apply to, but now the rules themselves.
