SIMON COWELL is considering launching legal proceedings against iTunes after fans were prevented from downloading X-Factor winner LEON JACKSON’s single.

Demand melted the music firm’s servers shortly after When You Believe went on sale at midnight on Saturday.

The problem was only resolved some 15 hours later leading to thousands of punters being unable to get their hands on the ballad.

Last year LEONA LEWIS’ winning single shifted an astonishing 50,000 downloads on its first hour of sale.

The Scottish teen logged just 36,669 sales in three days and record label bosses are furious.

An insider at SonyBMG said: “Everybody here is up in arms.

“There’s been a monumental cock up. Simon is hugely disappointed about the situation and is considering launching legal proceedings.

“Everybody is really upset for Leon and don’t want technical malfunctions to mar his big week.”

A spokesperson for iTunes declined to comment.

Happily though, the crooner from West Lothian WILL land the coveted Christmas No1 spot despite the digital disaster.


Physical copies of the single, which were released on Wednesday were flying off shop shelves at the rate of 40 a minute.

Analysts reckon the single, which was originally recorded by MARIAH CAREY and WHITNEY HOUSTON, will sell 300,000 by the end of the week making it comfortably the fastest selling single of the year.

An HMV spokesperson said: “Even at this early stage it looks like being Leon all the way.”

Boo, I wanted Leona to be the fastest selling song this year. She got a Guinness World Record for nothing then.

Co-host of the British talent show X-Factor Simon Cowell is considering suing Apple for a failure to cope with demand after posting the music from winning contestant Leon Jackson, according to a claim from The Sun. The newspaper claims to have contacts within Jackson's representing label Sony BMG who say that iTunes UK effectively collapsed moments after the artist's "When You Believe" single went on sale, preventing visitors from buying the music until the issue was resolved 15 hours later. The overload may have cost Jackson and Sony BMG valuable sales in the immediate wake of the show's ending despite indications the single will still be a strong seller.
"Everybody is really upset for Leon and don’t want technical malfunctions to mar his big week," says the alleged record label source.

The failure is said to be less than justifiable given Apple's previous ability to maintain demand. Previous X-Factor winner Leona Lewis tracked 50,000 song downloads within an hour and without any accompanying downtime, The Sun says, though the paper does not say whether the figure is attributable solely to Apple's online service.

An Apple spokesperson has reportedly declined comment, though the company is regularly connected to promoting music from talent shows associated with Cowell, such as American Idol.
