Default Jaffa Cake or Jaffa (Cake) Biscuit..?....

Nicola Sturgeon's declaration that Jaffa Cakes are "definitely a biscuit" has reignited an age-old debate about the sweet treat.

The question of whether the McVitie's snacks are classified as a biscuit or cake is one that has divided Brits for some time.

In 1991, McVitie’s was forced to go to court to defend its categorisation of the treat as cakes in a Value Added Tax (VAT) tribunal.

Since then, Jaffa Cakes are legally considered as cakes, which means the McVitie's does not have to pay the additional VAT that is required for chocolate covered biscuits.

But the Scottish First Minister insisted during today's press briefing that Jaffa Cakes are biscuits.

"In my humble opinion, a Jaffa cake is definitely a biscuit," she said.

"But there you go... that's probably one of the most controversial things I've said, and a brief attempt at humour in an otherwise difficult time."

Well I guess it's called a cake.
So cake will be it's likely category.

However if I was being offered a real cake, then a Jaffa cake would not be my choice.
To me it's more a biscuit.

I guess the makers decide it's likely category however.

As a footnote, however I don't like them anyway.

I class biscuits as having a crunch seen as though jaffa cake doesnt have a crunch I class it as a cake along the same line as mini rolls etc

They’re made of cake, biscuits aren’t made of cake

Cakes get harder if they sit out and go stale, biscuits get softer.

Jaffa cakes get harder if they're left out, thus, they are indeed cakes.

I don’t like Jaffa Cakes but I would class them as cakes. I don’t get why shops tend to put them in the biscuit isle tbh.

Whatever they are, cakes or biscuits, they're horrible in my view.
I agree with Dogeatdog.
They're identified as cakes but I know of no shops I go to, where they are anywhere else but in the biscuits aisle.
Unless in a promotional basket/bin.

If I went to a cafe and wanted to buy a small cake to have with tea or coffee, I'd never waste money on them entertaining them as a cake in that setting.
Even if I liked them.
I'd want A cake, a proper cake.
