Default Police are wrongly labelling hundreds of suspected rapists as women

BBC News Text:
[Police are wrongly labelling hundreds
of suspected rapists as women.
It says Freedom of Information requests
show police forces referred 260 self-declared
females to the Crown Prosecution Service
to be considered for a rape charge.
By law, rape can only be committed by a
biological male, the paper notes.]

Can't women rape people though?

Not as common I know, but it's surely a thing isn't it?

Technically not, because rape by law is defined by unwanted, or forced penetration, so even if a woman has sex with someone against their will, it can’t be classed as rape, just one of the many advantages women have over men in the justice system

This about men abusing the system to pretend they are trans people to get better sentences/conditions - it has nothing to do with women

Yes forced penetration specifically "with penis" too, not with an object. Women can of course be charged with sexual assault and it's not particularly an "advantage" per se, because a woman who has committed a very serious sexual assault or multiple assaults can get as much (or more) prison time as a man on a rape charge. It's largely semantics.

Self-declared gender ID is completely borking crime stats though, it's making any research into the gender division of criminality much harder.

The U.S. changed their legal definition of rape about a decade ago to:

“The penetration, no matter how slight, of the vagina or anus with any body part or object, or oral penetration by a sex organ of another person, without the consent of the victim.” For the first time ever, the new definition includes any gender of victim and perpetrator, not just women being raped by men.

What's wrong with identifying transwomen as transwomen in crime statistics?

Why muddy the waters by listing as women?

well that would seem the obvious and most practical answer, but...but...but...

Fair enough about how the law views it.

I imagine that the law probably categorized female predators more in the sexual assault criteria?
