Default Specks and Planks

Today's text

The betting is now that Grace will beat Sezer's percentage.

According to my research, i.e asking a female co-worker who is not following Big Brother, it is a common and normal trait amongst young femails to talk about each other in a negative way behind each other's backs.

It is likely therefore that members on this and other Big Brother forums may engage in this activity without realise they are doing it. If Grace was doing this deliberately to influence nominations in the way that Nicholas did in BB1, she would have connected that in the diary room on Friday.

She did not.

She did not realise she was "back stabbing" as some put it.

I put it to you that my client is being villified for something that is, although unpleasant, a normal activity everyone engages in from time to time. I put it to you that the reason she is hated is that people are seeing in her something that they dare not admit to themselves, and she is a constant reminder of that character flaw, no wonder the words speck, eye and plank comes to mind.

Mi Lord, I ask the court to look at the record of how this activity was prevelant in all Big Brothers, indeed in Big Brother 3, they did a feature on this early on in the psyche report.

My Client has not done anything more than what many people of her demographic do on the outside word.

There is no evidence my client has breached any rules about influencing nominations, unlike other housemates

I put it to the court that my client has no case to answer.

Barrister if you please

A solicitor does not get to appear in court, the barrister does.

It isn't just the fact that she is bicthing, she's doing in a way that is causing upset and tears among the rest of the group!

In my eyes, she has been very manipulative and sly to all of the housemates in there, continually lying both in front of there faces and behind theres backs.

She is the reason there is a devide in there, nobody else.

She was the reason Sam ended up crying last week and Nikki the week before.

She is the reason there are constant bitching sessions!

The only reason people are now defending her actions is because you have been tricked into feeling sorry for her with them fake tears she keeps sheding in the dairy room.

I agree 100%. I'm a top bitch.

It's in our nature as females to act that way, especially at Grace's age. I was probably worse than her at that age.

Your case is flawed. You have argued she should not be blamed for what she does, as others do it all the time. Yes other people do back stab, etc. But from MY discussions with people, it is not the fact she is back stabbing, but the WAY in which she does it. She is truly odious and snobbish in her approach, dismissing other housemates for no reason but because she feels superior.
One cannot merely look at the actus reus (the back stabbing), but also the mens rea (the thought behind the action). In Grace's case, the latter is merely to put others down because she actually thinks she is some princess, as girls have said to me, she is just like bullies they encountered at school.
Others who also back stab have a varying mens rea from Leah who is clearly one of the most insecure people there, to Lisa, who is plum ignorant.

I always understood that only a barrister could appear before a judge, is this the case for courts above magistrates?

Hi Sticks -

Exactly. In the Crown Court, you encounter the 'wigs', which is the barristers, so to speak. In the magistrates court, your solicitor can represent you, as they can in the civil courts. Similarly, judges in these lower courts don't have to be qualified, they can be lay magistrates, but in the Crown court, this would not be the case.
The best way of looking at it is that a barrister ONLY really appears in court. All the preliminary meetings and conversations are with the solicitor.

Thanks for that incite

In my minds eye guess I was thinking of the Crown court. The attached file should give you an idea of where some of my original knowledge of the law came from. (Now added to by subsequent media exposure)
