Zimbabwean Big Brother star Makosi Musambasi has won her battle to stay in the UK as a refugee.

The ruling was made by the central London asylum and immigration tribunal on Thursday.

The 25-year-old had her working visa curtailed and faced deportation after she left her job as a cardiac nurse to appear on the C4 reality show.

Ms Musambasi, of High Wycombe, Buckinghamshire, came third in the show behind Anthony Hutton and Eugene Sully.

The Home Office gave the former nurse notice to quit the UK in August since she was allowed to stay only as long as she worked as a nurse.

On learning of her imminent deportation, Ms Musambasi, who came to Britain in 1998, made an asylum application which was rejected earlier this month.

Violent confrontation

However, the tribunal ruled that she could face violent confrontation if she returns to her native Zimbabwe, following her lewd behaviour on Big Brother earlier this summer.

Ms Musambasi told the tribunal that she feared for her life should she be forced to return to Zimbabwe, where she claimed she would be "looked at like I have violated a lot of cultural rights just by wearing a bikini".

"It would not be safe for me to return at the moment," she told the hearing.

"The police know who I am now. They know I am scared to return because of documents put in the newspapers."

"She is in a different situation now than she was some seven months ago before appearing on Big Brother," said tribunal chairman Francis Pinkerton.

No problems

"Before that she had been to Zimbabwe on a number of occasions and presumably encountered no problems."

"The appearance on the show has changed things a great deal."

"Her evidence is that she now does fear to go back to Zimbabwe."

"She is therefore a failed asylum seeker and we find that because she is an involuntary returnee, she is a refugee under the 1951 convention and therefore we allow her appeal on that basis."

As a refugee, Makosi can now stay in Britain for five years.

The Home Office said it was "disappointed" by the ruling and may appeal.

If she really was at risk of 'facing violent confrontation', then of course it wouldn't be right to deport her. But at the same time, surely she knew that her behaviour would be frowned on, too? I don't think I'd like the responsibility of that decision either way, though. I'd be happy just to know that we'd never have to see or hear from her ever again.

I dont like her at all, but it doesent mean I want to see her in danger.

If after considering all the evidence they have decided she would be in danger, then its right that she should be allowed to stay.

What happens after the 5 years are up?

Well, she certainly shouldn't be sent back if she would be placed in danger. But surely she must have known how her behaviour would be received, while she was in the house and behaving in that way? Unless of course, she never expected that she might have to go back in the first place...

im pleased shes a llowed to stay. Ive read some of the comments about her on various zimbawee forums and she is a public hate figure over.
She did say she will go back to nursing and if she does hopefully there wont be any more problems in the future

I agree Ruth.

She is out to make as much money and fame as she can from the show. Roll on BB7 so she can go back into the shadows. Thing is, while she continues to be in the public eye she can't be sent home. The situation she finds herself in is all of her own making.

i like makosi, i thought she was great, you lot should grow up theres alot worser people in the world than her, so before you start slating somebody who lied alot, why don't u think of all the murderers, rapists, people who are cruel to animals and bullies in the world, they are far worse than her. So leave her alone a bit

This is a Big Brother forum. I don't remember seeing any "murderers, rapists, [or] people who are cruel to animals" in the house. As such, Makosi is fair game. She made herself into a hate figure - why mock her achievements?

There are worse people than Makosi in the world - there's a lot of people who are a lot better than her as well! And believe me, I'm pretty sure Makosi would HATE it if everybody left her alone.

Well I neva liked Makosi in the house she was very conniving and she wanted to get all the fame as possible plz do not fall for this sad newspaper article she also tried to bully anthony into saying they had sex together I mean why wud anyone want to do that plz!?
