Default Ebay seller won't pay return postage after he said he would

Yeah I know I could go on the Ebay forum and discuss this but this is the second time I have ordered a phone on Ebay and it's arrived broken.

Been on the forum once before, but didn't get any constructive help, so I am venting my anger on here.

Anyway, I bought this Android phone, it didn't work, so I asked to send it back for a refund. I was insistent the seller pay for the return postage, and he agreed four times in four different emails.

So I spent £3.90 returning the phone and guess what, he refunded the cost of the phone but not the postage.

I complained to Ebay and they said there's nothing that could be done.

Any suggestions please.

Can't you forward the emails to Ebay as proof? or have you already done that? Knock stars off in his rating also, bad ratings can affect their sales can't they, so you could email him that as he went back on his word you feel obliged now to show that in the rating.

Sorry I am not much help.

Did you open a return request. If so he does have to refund your postage if the item is defective. I would tell him you will have to reflect the service in feedback as suze said but there is probably not a lot you can do Im Afraid unless you opened a return request

He will be unable to refund you anything more than you paid via ebay so what he has to do (and all sellers) is refund you as he has done and then in a separate Paypal payment refund your postage.

But you need to tell him what the postage was and he will only refund you once the phone has arrived.

I would just be happy he returned the price of the phone and chalk this one up to experience tbh, give him a terrible review and move on.

Also (and this has happened to me a few times) he may have refunded the money (separately) and you have not noticed it or (again has happened) he refunded it and got your email address slightly wrong and its in the ether unclaimed.

Ebay has rules
if the Seller has broken the Rules
then all the data must be sent to Ebay USA

Thanks for all your replies.

I don't think I will take Josy's advice, even though I say thanks for it. Why should I have to pay for the seller sending me a broken phone?

I also paid for a £1 jiffy bag, so it's a fiver realy.

But luckily I found this:

http://www.which.co.uk/consumer-righ...a-faulty-item-

Letter to refuse paying the cost of returning a faulty item

If you wish to return a faulty item bought online, you should not incur the cost of returning it.
If the seller or retailer is insisting you pay, use this template letter to explain to the retailer that it must pick up the cost of returning a faulty item.
If you'd rather speak to an adviser about your problem, call the Which? Consumer Rights Advice Line on 01992 822 829 to join today

Yes, there's proof on the Royal Mail Tracking Site too.

A bit of good news.

I showed that link to Which, and he coughed up £3.82 - 8p short of the £3.90. You have to laugh at that.

But I lost a quid on the jiffy bag.

Dearie me, what a bunch of amateurs they are.

Thanks for all your replies.

But do note that a seller cannot refund postage in the same refund as cost price. That always is a separate payment
