Chris Brown has been spared jail by a judge after a prosecutor accused him of being “an increasingly violent danger to society.”

He was praised for his good behaviour and progress in rehabilitation by Superior Court Judge James R. Brandlin – who denied a prosecution request in an assault case.

Prosecutor, Los Angeles Deputy District Attorney Mary Murray, called for 24-year-old Brown to be jailed during the hearing on Monday.

Murray also wanted a full probation violation hearing in relation to evidence from a recent altercation.

Brown was arrested and charged in connection with a fight in Washington DC, just a few hundred yards from The White House, and was sentenced to three months of in-patient rehab in November.

The singer agreed the terms which were suggested to him by probation officers involved in his sentence for an attack on then-girlfriend Rihanna in 2009.

Referencing the alleged fight in DC and an incident when Brown threw a brick through his mother’s car window after a therapy session, Murray wrote: "He continues to pose an increasingly violent danger to society.”

Murray claims to have made the demands over information the reported victim of Brown’s bust-up allegedly suffered a broken nose in the attack.

However the singer’s lawyer Mark Geragos insisted the only recent changes in Brown’s behaviour were positive, which has been concurred by his probation officials who said the Grammy-winner "appears to have a more serious and responsible demeanour" since checking into rehab.

The case is back in court on February 28 and the judge has ordered an update on his progress after it was told how Brown had completed just 191 of 1,000 hours of community service. Brown’s laywer says the singer is not guilty and that he has rejected a plea deal.

Brown had violated his probation last year after failing to exchange ‘proper information’ after a minor car crash.
