Well considering they have charged the boat’s owner with manslaughter and impounded the boat … then they stated the was no ‘contact’ with the boat or the victims… plus the boat made many trips to and from the harbour to the area by the pier .
It can only be that on one of the day trips the boat made some massive waves ( maybe the captain was showing off and going too fast ) and that caused massive waves that put everyone in difficulty ?!?! Not given, they are told where to access them, same as on a plane, maybe there just wasnt time to get to them

Presumably they were at the pier where the boat drops off/on at and when the boat pulled away they got sucked under by the tow?

This is exactly why I would never swim near the pier.
I don't go too far in the water. It's not safe, anything can happen there. It's possible that they were overwhelmed by the bigger waves.

Sooo if rip tides are a natural phenomenon presumably there will have been loads of similar instances around that area !!
