Default Big Brother star loses libel action

Big Brother 4 housemate Lisa Jeynes, who claims that she was portrayed as a man posing as a woman, today lost her appeal against a judge's decision to throw out her libel action.

The 39-year-old model, who featured in the 2003 series of the reality show, was not at the Court of Appeal to hear three judges conclude that such a meaning would be irrational, fanciful or absurd.

She had wanted to sue for compensation up to £150,000 over publications on the cover of Love it! magazine and in the News of the World in May 2006.

She had complained about the words: "BB's Lisa 'the geezer'. My fake boobs fell out on date with James Hewitt!"

She said that the innuendo - against rumours at the time that there was to be a transsexual contestant - was that she was really a man posing as a woman, a transgender or transsexual.

News Magazines Ltd and News Group Newspapers, who denied libel, argued that the words complained of taken in their proper context could not bear her "far-fetched" meaning.

Last April, High Court judge Mr Justice Eady dismissed her claim, ruling that no reasonable reader could conclude that the words complained of bore the meaning she alleged.

"That would be to read far too much into those words," he said.

Ms Jeynes, of Teasel Avenue, Penarth, South Glamorgan, will now, by agreement, pay the defence costs of the appeal of £26,669 within 28 days. She was also faced with a costs bill of £6,750 after the High Court hearing.

Dismissing the appeal, the Master of the Rolls, Sir Anthony Clarke, sitting with Lord Justice Tuckey and Lord Justice Jacob, said that he agreed with Mr Justice Eady that no reasonable reader of the words complained of could come to the conclusion suggested by Ms Jeynes.

"Any such conclusion would be perverse."

He added: "I have concluded that this is a case where the suggested meaning is irrational...fanciful, absurd or factitious."
