Fury over killer's 'outrageous' sentence of less than five years for fatally
choking mother-of-two, 33, then claiming he did it during consensual rough sex
Sam Pybus, 31, admitted killing Sophie Moss, 33, in Darlington in February
Miss Moss was taken to hospital but was pronounced dead a short time later
Pybus was charged with murder but plead not guilty, which was accepted
Instead, he admitted 'unlawful killing' and pleaded guilty to manslaughter

Sam Pybus, 32, killed mother-of-two Sophie Moss cheating on his wife after
drinking 24 bottles of lager.
He reported her death in her home in Darlington, Co Durham, himself at a
police station and told investigators the choking had been consensual.
But after he denied murder at court the CPS accepted his admittance of
manslaughter - despite the 'rough sex defence' being banned in April last
year.
Miss Moss, 33, who was mother to boys aged just six and five, was described
as vulnerable by the court and was someone who had struggled with her
mental health in the past.

Bull****, he's panicked that she might tell his wife and murdered her. Sentencing for these things is an absolute joke - if they need to free up prison space, focus on non-violent crime and keep these people where they belong. I've seen addicts get 2 years for repeated shoplifting or for minor assaults (i.e. mutually fighting each other in the street) - how about stop putting those people in prison and get them actual help in the community, and free up plenty of cell space for handing out proper sentences to blatant murderers.

Some people do like being choked during sex, and I'm gonna go out on a limb and say some people do die as a result of it...
If it was something he did frequently with his girlfriend (and wife) then it's plausible it was an accident.
Should someone face a murder charge for an accident? Reckless drivers aren't murderers.

All you have to say is it was a consensual sex game gone wrong and they lap it up.

To actually kill someone by choking takes some strength and time....she would have struggled and then stopped as she lost consciousness and he will have still had to continue until death occurred. No way is that an "accident". I would imagine TS is not far off from the mark - possibly worried his wife may find out and wanted to ensure that didn't happen.
Even if it were an accident - his actions have taken a mother from her children and he needs to pay for that.
The sentence is a joke.

If it was an accident you dont sit in the car for 15 whole minutes wondering to call the ambulance who may have been able to save her

Oh absolutely. Even if he's not a murderer, he should be locked up for longer than his current sentence.

Yeah, take his word for it that it was consensual rough sex. Not like the woman is here to verify that for herself. :umm2:

Even if someone does like being choked, there's a difference between BDSM and choking someone to death. I don't think you could accidentally choke someone to death with your own hands, there has to be intent there.
Yeah, like if it was BDSM, he would have stopped at some point when she would have began to struggle.
You don't choke someone and only realise something's wrong after you've killed them.

It's a dangerous practice regardless and even if we do accept the premise that some people like it (which is much, much rarer than is made out) it's not a good idea. But the reason it's not a good idea is mostly the risk of having a seizure or stroke because of restricted bloodflow. To actually choke someone until they're dead means it's either been continued after they passed out completely, or it was so hard their windpipe was crushed. I'd go as far as to say that 99.9% of these "accidents" are simply not accidents at all.

It's easy to plead "it was consensual!" when the victim is no longer alive to say otherwise. Choking someone to death takes a lot of force and a considerable amount of time. This was not an 'unfortunate accident' in the slightest.

People DO enjoy being choked during sex.
Common sense tells you that if the recipient is struggling with it to stop though.

1) Not many people genuinely enjoy it
2) It's risen dramatically in "popularity" (expectation) since it became commonplace in porn.
3) There is no safe way to do it - it is inherently dangerous and dumb. But each to their own if it's genuinely with enthusiastic consent. 99% is not.

1) Agree. There are many who claim to enjoy it but I doubt they actually do. See part 3)
2) No doubt, but Porn is for men not women so not surprising. Any woman who is prepared to do the humiliating things that todays porn actress does?....Seek help. Pornhub actresses are well paid to do this stuff anyone who does it for free :umm2:
3) from Part 1). It has to be a completely controlled environment to be, at all, enjoyable. A scene Where the people are comfortable and happy that the right amount of pressure is to be applied, there are clear stop signals etc. There are too many things that can go wrong.
So throw the book at this creep. He lost control and killed her so must pay the price. She has paid the price with her life..

There is a huge difference from enjoying choking / being choked to what has happened here...
No consensual relationship would allow choking to go beyond sexual gratification to struggle, then unconsciousness and finally death.
This is not am accident....

HE must have had some signs of a struggle on his clothing and body - Scratches etc. yet still claims it was consensual. No chance

It’s unlikely to happen if he’s drunk. I’m also able to overpower him if I needed too which obviously in this case she wasn’t able to do.
This wasn’t an accident.

Like I said, people who do obviously exist and to an extent each to their own. All I can say is be careful because like I said, there’s no safe way to do it, and a bit of pressure in the wrong place (on your carotid artery restricting blood flow to the brain, rather than restricting breathing) and you could have a seizure (potentially bad) or a stroke (obviously worse). And it’s not a matter of being careful/aware, it can take literally a couple of seconds to cause a seizure, and a couple of seconds longer, if your partner doesn’t realise it’s not “happy convulsions” but “oh no he’s pissed himself and swallowed his tongue” convulsions, for you to have a bleed on the brain.

If the court believes he drank 24 lagers first and then strangled her "during consensual sex"... then they'll believe anything.

When I was a teenager there was a bloke who lived across the road to us found hanging off the bannisters with his cock in his hand. Seriously, you can have great sex without putting your life at risk. And if you can't... if it doesn't hurt when you pee, perhaps just use it for that.

I didn't want to generalise too much based on sex but I have heard cases similar to that and it's always men. You never hear of women choking themselves to death in a self sex game gone wrong. It's always a man saying oh she wanted me to do it after he's killed her. I don't think you can count women in porn because they're getting paid to act out what men want/like to think women enjoy.

No, you never hear of women choking themselves... that's true. I feel like this defence is going to be used and abused in the future and apart from filling the defendant with a truth drug or beating it out of them, there's going to be no proof either way.

When I was in Uni halls a guy in our block came into the kitchen a bit distressed, and relayed to us a tale of how he'd been trying it out using a belt attached to the back of his door, and that he'd suddenly realised he couldn't get down and panicked and almost passed out (at which point he'd probably have died) ... why he chose to tell us all that I'll never know, seems like a story you'd take to the grave :umm2:.
He was full of fanastical sex stories though, in 3rd year him and his girlfriend got into chemsex (sex on various drugs, for the uninitiated), which they then abruptly stopped after having sex on a bad LSD trip. And I swear he's never been the same since... he was really anxious for the rest of our time at Uni, and I see him crop up occasionally when I log into Facebook. He still looks... haunted. That **** was something like 14 years ago :joker:.

Just to add some tidbits to this thread (because I have a habit of obsessively learning about things when they come up) I've been reading up and it's actually even worse than I was aware of before :umm2:
- As well as the strokes and seizures, pressure on the neck can cause cardiac arrhythmia (irregular heatbeat) and cardiac arrest because the brain is saying "I don't have enough oxygen" and the heart goes into overdrive.
- Many high-profile bondage and BDSM experts advise against it even for non-amateurs because it's so risky and unpredictable.
- The reason people like it is because when the choke stops, the brain gets a dopamine flood and the person experiences euphoria. Which for one means it's addictive, and two means people might need to "increase intensity" to achieve the same effect over time, which makes it increasingly dangerous.
- If someone is doing it regularly over a long span of time, the risk of brain damage actually shifts from "risky" into "likely".
I dunno. Should it be illegal? Probably not, it's still up to individuals if they want to take that risk I guess, but honestly I think the only people who are doing it should have sought each other out specifically. I think even suggesting a partner try it as either the choker or the chokee is a massive ?? in terms of informed consent. Even if you're asking someone else to choke YOU, you're putting them at risk of having to live with the legal and moral consequences of potentially killing or severely/permanently injuring someone.
