The judge added: “Another thing that is troubling is what appears to be a factual inconsistency in the current pleaded cases that the Duke of Sussex did not have the knowledge [of the alleged wrongdoing] before 2019 and your proposed amendment seems to say he would have brought the claim in 2012 but for the secret agreement.”
Harry’s barrister, David Sherborne, said the claim in 2012 would have been “totally different”. He said there was a “draft” of an amended particulars of claim which contains the alleged secret deal.
The judge replied: “I am talking about the factual inconsistencies in the case as pleaded.”

I can’t find anything on this being mentioned in the court case by the Mirror or any evidence - could you post the link from where you seen this?

How do you know they havent ? plenty of kids go through much worse ,I liked Diana but dont think there was anything sinister in her death just a drunken driver, lack of seatbelt use and French paps. People fall for others all the time and Im sure Megan loved hearing him say the press ruined his relatshionship with Chelsea I dont dislike Harry but it does seem he can dish the dirt but others cant about him, just go home to America Harry and be happy with your family, this is all affecting his relationship with his kids aswell.

So the deadline for Harry to produce documents was yesterday, and he didn’t/couldn’t produce them. He seems to just jump into these litigations with two feet, without a solid case. I don't know, maybe it's boredom because he has little else to do with his time. Those lawyers of his are laughing all the way to the bank. In an article on the Daily Mail website the paper said he had "abandoned his case" hours before a court deadline.

It said the prince would be liable for the publisher's £250,000 legal costs.

The Mail on Sunday article, published in February 2022, had reported on the prince's legal challenge against the Home Office over changes to his publicly-funded security that had happened after he had stopped being a working royal and moved to the United States.

After the claim was dropped, a spokesperson for the Sussexes said the duke was instead focusing on the safety of his family and his legal case against the Home Office.

"His focus remains there, and on the safety of his family, rather than these legal proceedings that give a continued platform to the Mail's false claims all those years ago," they said.
