as some may know I had a nightmare in a property last year which saw £7000 of mostly criminal damage. in a house with 6 kids and 2 dogs (plus puppies being bred for money)
well a relative of theirs is at one of my other houses..... she also breeds dogs for money. except she didn't bother feeding or giving her dogs food or water...the rspca were called, there were utterly useless...they took 1 dog out just about alive the tenant was unaccountable but when they did finally see her leaving the house she said the dog had died weeks ago and was buried somewhere in the garden this same tenant has over 50 rubbish bags in the garden, now there are rats...the neighbours spent £200+ on pest control and now have a water leak running into their house from mine the same tenant has stolen the housing benefits, hasn't paid rent for 8 weeks and has even forged documents with my signature to claim housing benefits the person has both keys due to a marital split and I have no key by the letter of the law I am still powerless to go in there and save my house and perhaps a dog who may be in there still the public health did nothing, the housing benefits fraud did nothing, the police I haven't bothered, the housing benefits team did nothing, the rspca did almost nothing , shouldn't someone be taken to court for letting an animal starve and aother to almost starve? what a state of a country we are? what would you do if you were me? its reached the stage if the house was on fire, id be breaking the law by going in to put it out now they have landlord personal licenses next AND landlord property license per property...those forms are 20 pages the fees go from £300 to £840 per house additionally all housing benefits goes direct to tenants who often simply steal it, trash the house, report the house to the council then eventually leave with no accountability and stolen housing benefits yet this story is never told, for some reason the populist approach is all landlords are evil money grabbers the logic alone says the landlord has a vested interest in maintaining his property and the tenant does not this isn't politics this is real politic....the actual end result of the moronic idiocy that takes place in Westminster and beyond....it seems to be everything is unfit for purpose what on earth am I going to do? If it's costing you that much, it may sting, but just pay them off in cash to vacate the property. If they refuse - pay that money to someone else to convince them (the people you hire will probably already know them).
Then, ffs truth, start interviewing your prospective tenants and be more selective. It's not THAT hard to spot these people. |

How do you know the dogs are starving? If you have evidence, then you go to the police.
You need to get rid of the rubbish. Give them notice of when its going to be removed and tell them what the fee is....not that you will get it but you will at least free your garden of rubbish. You need to fix the water leak. Again give them notice of when you will be entering the property....Wait, you do have a contract that states you have a right to enter the property with due notice, if a repair needs doing? Why didn’t you get a 3rd key cut? presumably one of the tenants on the contract has moved out due to the split? Are you aware that this made the original contract null and void and a new contract must be written up for the remaining tenant Do you fully understand about property law and your rights as a landlord? Did you make sure the contract was water tight before allowing these new tenants in? Have they actually signed the contract? I agree that this licensing scheme is all smoke screen and mirrors. Its just another government scam and the only ones who benefit are the local councils. Stop taking in people on benefits. I know that sounds harsh but you don’t have a leg to stand on if they decide to withhold rental payments. The government/council will protect their rights rather than yours because they don't want to take on the responsibility of re-homing them.

If they are not paying you the rent and they are in receipt of HB then the council have to do something, threaten legal action on the council if they dont.
Also as a landlord you are legally allowed to enter the property if a certain amount of notice is given to check for any repair work that needs doing. Leave a message for the tenants and write, give a date and time and then go with someone else and a camera for the inspection. The only other thing is inform the tenant that you are selling the property and you will need them out and the house cleaned by a certain date. Tell them to either post the keys to you if they leave before that date or you will pick them up on the morning of the day you want them out.

[QUOTE=DemolitionRed;7898449]How do you know the dogs are starving? If you have evidence, then you go to the police.
-1 DIED THE OTHER WAS TAKEN AWAY BY THE RSPCA. SHE SAID THE DEAD DOG IS BURIED IN THE GARDEN SOMEWHERE. THIS WAS REPORTED TO RSPCA BUT NOT THE POLICE YET You need to get rid of the rubbish. Give them notice of when its going to be removed and tell them what the fee is....not that you will get it but you will at least free your garden of rubbish. IVE GIVEN NOTICE FOR WEEKS, THE ENORMITY OF RUBBISH HAS ATTRACTED RATS AND THERES A WATER ELAK NOW TOO You need to fix the water leak. Again give them notice of when you will be entering the property....Wait, you do have a contract that states you have a right to enter the property with due notice, if a repair needs doing? IVE GIVEN NOTICE TO INSPECT ALREADY Why didn’t you get a 3rd key cut? presumably one of the tenants on the contract has moved out due to the split? Are you aware that this made the original contract null and void and a new contract must be written up for the remaining tenant THE COUPLE SPLIT SHE KEPT BOTH KEYS, I DONT HAVE 1 Do you fully understand about property law and your rights as a landlord? Did you make sure the contract was water tight before allowing these new tenants in? Have they actually signed the contract? I HAD A 6 MONTHLY AGREEMENT WHICH ENDED IN LATE MARCH. SHE WROTE A FORGED AGREEMENT WITH THE HOUSING BENEFITS. IVE INFORMED THEM OF ALL THIS AND STILL THEY ARE NOT ACTING TO HELP ME GET HER OUT, THEYVE MERELY STALLED THE PAYMENTS WHICH MEANS NO RENT FOR ME I agree that this licensing scheme is all smoke screen and mirrors. ILL NEVER EVER TAKE ON PEOPLE WITH HOUSING BENEFITS AGAIN , ANYONE WHO DOES WOULD BE CLINICALLY INSANE THIS SECTION LOOKS INTEERSTING Then there are times when they will have to go in – for example when carrying out the annual gas AND ELECTRICITY safety check or to do the quarterly inspection. What about that? What about legal rights of access? But what about those circumstances when the landlord is given a statutory right to do something – such as s11(6) of the Landlord & Tenant Act 1985 which provides for landlords to be authorised to enter the property after giving not less than 24 hours written notice? Or clauses in the tenancy agreement which provide for the landlord to have a right to enter, to (for example) carry out the annual gas safety check or show round tenants during the last month of the tenancy? SECTION 11 (6) In a lease in which the lessor’s repairing covenant is implied there is also implied a covenant by the lessee that the lessor, or any person authorised by him in writing, may at reasonable times of the day and on giving 24 hours’ notice in writing to the occupier, enter the premises comprised in the lease for the purpose of viewing their condition and state of repair. |
