Yes and as jedward fever says it is against all the rules of the X Factor and if its really verified she will have to be removed from the competition and also be scrapped from the tour as if its true as Novo says it is then she was totally unacceptable to be eligible to be a part of the X Factor at any stage and has deceived the producers.

Automatic elimination from the competition would have to be done so as not to set a precedent for other acts applying for X Factor in the future.

She may just have shot herself in the foot here.

If as Novo says this recording is coming out within the next month and it is her on it.
Once that is known for certain then as they did with a group one year in Louis category, before the live finals, they found out they had a signed agreement with a company and Louis had to drop them out of his final choices for the finals and get another group in. She will have to be removed from the competition and also anything connected with X Factor.

So it would be likely the place on the tour would be then offered to whoever came 9th in the competition, which would be Aiden,if he wanted to that is.

ive just googled matt cardles album,he was in a group that split up before he auditioned for the x factor.

He was in a group, he is now performing as a soloist, as he was in a group he would have little control over all the detail Katie as a soloist would have, they are 2 entirely different circumstances.

If both are true the difference is that Matt is not seeking a new contract as a group but as a soloist, in Katies case all agreements would have been signed as a soloist and she is seeking the same now, you can't do like for like twice.
