It should be illegal and it will be eventually, I'm sure. But there's a whole muddle around stalking, voyeurism etc. There was a case of someone being filmed through the window of his house by someone he'd had a disagreement with. The police told him that peeking, or even filming through someone's window is not an arrestable offence unless it's proven that it was being done for voyeuristic purposes.
