He literally can't be unless the victim claims that he was physically forced, threatened with violence or drugged, or that he had repressed memories and only just remembered the incident. But from what I remember, none of those things apply... so he won't /
can't be charged.
As I said earlier, whether or not this is RIGHT is another question. I have mixed feelings about the US's statute of limitations laws.
