three years ago is an extraordinary and ill-advised incursion by the judiciary into the political arena. Mr Johnson, the front
runner in the contest to become Conservative Party leader, has been arraigned for “misconduct in public office” over the claim
that £350 million was sent by the UK each week to the EU. At the time, Mr Johnson was both an MP and Mayor of London, and
it is in these capacities that he is said to have broken the law.

The case was brought not by the police but through a private prosecution mounted by a Remain campaigner, Marcus Ball.
It is so evidently a political stunt intended to damage Mr Johnson’s leadership ambitions that it should have been dismissed.
But district judge Margot Coleman has ruled that there is a prima facie case to answer and Mr Johnson has been summonsed
to a hearing in the middle of the leadership election.


The offence of misconduct in a public office carries a maximum sentence of life and is triable only in a Crown Court on indictment.
The Court of Appeal has made it clear that the offence should be strictly confined because it can raise complex and sensitive issues.
Guidelines from the Crown Prosecution Service state that advice should be sought “to resolve any uncertainty as to whether it would be
appropriate to bring a prosecution for such an offence”.

However, this is not a case brought by the CPS, but by a private individual crowd-funded by internet donations amounting to £400,000.
It seems clear that this case does not pass the test for a criminal prosecution, otherwise why has it not been taken up by the CPS?

In her ruling, District Judge Coleman states that “as this is an unusual and exceptional application with a considerable public interest...
the principles of open justice required that the application be in open court.” But the point here, surely, is that this is not a crime but

It is not for the courts to impede free speech in this way. Furthermore, this is manifestly a vexatious misuse of the justice system
because the litigant must know the case will not succeed but relies on the process itself to inflict damage. This is a threat to democracy
and a higher court needs to strike the case down urgently.

How Boris Johnson's accuser over Brexit spent donations on self-defence classes and special cupcakes

Only three years ago, then aged 26, he was a failed entrepreneur with a string of wound-up businesses to his name, living at home in Norwich with his family.


A source close to Boris Johnson said: "The claimant asserts that he is not motivated by politics. This is a blatant lie."

It was less than a year after founding the campaign, according to the accounts, that Mr Ball first dipped into the funds, loaning himself £1,000. Soon afterwards he informed his supporters that even more money was needed.

According to Brexit Justice’s accounts, published openly on their website, increasing amounts of money were taken out to pay for Mr Ball’s new life in London. Over the past 27 months, it emerges, he has spent more than £50,000.


Expenses include more than £6,000 to pay for the rent on a London apartment in a luxury tower block near Canary Wharf, a far cry from his parents’ home in Norwich.

“I chose a building which had security staff, security cameras outside and inside, as well as fitness facilities on site,” he explains in a note to his supporters.

“Some people may criticise me for spending so much on rent, but I don't regret this decision.”

Other payments from the fund include £120 on professional headshots of Mr Ball, as well as £333 on “self defence classes”.

“By protecting myself I protect our work,” Mr Ball explains.

He also spent £504 of campaign money on his personal mobile phone bill, as well as £120 on “two dozen cupcakes” branded with the Brexit Justice logo.

Didn't the Liberals at one point promise to do away with school fees or something like that , was anything done about that lie ? the timing of this is a bit dodgy, as much as Boris can be a tit ,we should have equality at least, this seems like sabotage.

For instance, I wait with breathless anticipation to see what's going to happen to Shami Chakrabarti when the The Equality and Human Rights Commission find there IS an anti-Semitism question to answer in the Labour Party, when she said quite clearly that there definitely wasn't.

I read that the Bruges Group estimates the real cost to us of being a member of the EU is more like £600 million + per week due to an complicated system of payment that the media largely ignores.

I'm quite looking forward to the trial, to be honest. It's going to be a lively one.
