The justification they have for this is obvious and they're not even shy about stating it: to be prisoners rather than hostages in a war, they have to be enemy combatants. Israel's propaganda is that ANY Palestinian who didn't immediately somehow leave Gaza as soon as they were told to is an enemy combatant. Thus, when captured, a prisoner of war.
