Would you be saying the same thing if Austin nominates James? After all James is the one that keeps going against Austin on everything and keeps deliberately making himself look like a victim against his "friend" in the house.

Of course if Austen has a valid reason to nominate. But I disagree that 'James is going against Austen.' James is his own man, he is not Austen's puppet. He doesn't look like a victim at all. He looks like a man who has an opinion of his own and sticks with it.
