The guy sounds really stupid, classless and gross especially sharing photos with his mates! ,that's just messed up .

But the alarming question is why the hell is a 12 year old who hasn't even hit her teens yet! using a site to meet older men for sex!!???? , or is it just me questioning this insane business!! .

You would think he'd twig something seems suspicious about her , but it's obviously he's brainless anyway . But i will say yes some youngsters can pass for being older . Whether or not she looked 19 i'm not sure about that .

This is such a mess, I hope child protective services got involved and figured out how a child was even able to get in that situation.

The man sounds terrible, especially for taking the picture and sharing it with a friend, even if he did it with a girl of age.

I hope a lot of people will learn from this story, really devastating for both involved and both of their families.

dont any of you remember what you were like at 12, its that age where one minute you want to be an adult, the next you are a child again, bottom line here is she was a child and he was more than twice her age, the onus was on him no one else

I think times have moved on, have heard a group of ten year olds speak lately?

The language and conversations are shocking, plus the female body as actual changed, breast sizes have got bigger, not all twelve year olds look like boys of the same age.

Some kids are older than their years, some kids are carers to their parents, some kids are working harder than adults in seeat shops.

Kids should not be having sex and adults should not be having sex with kids because that’s sick abuse.

What I’m saying is not all kids are the same, and as for looking their age, my daughter is 24 but can’t buy a 18 dvd on her own that means to the person serving her she looks at least six years younger than her real age.

You are generalising a while group there to fit your agenda, yes some kids mature faster than others that is nothing new, some want to be grown up before they are ready etc, and you have also made the key point your daughter looks younger than she actually is, other girls look older and that is why the onus is on the adult to make sure of their age before engaging in sex especially with someone you meet from an app and who you have no background knowledge of

No I think Cherie is right to be fair Sheriff. My daughter is "old for 9" cutrently; she's tall, looks about 11 or so, acts and talks like a teenager when she's with her friends, enjoys playing with make-up (she's not allowed to wear it regularly though) etc.

Giving it some thought; I suspect this guy just didn't understand the law and while he may have suspected she was younger than she was saying, he thought "it didn't matter" because he had proof that she claimed to be 19 (messages) and probably believed that this absolved him of any criminal responsibility if she did turn out to be under 16.

And that's precisely why it's still a crime even if the underage person has claimed to be of-age, otherwise it would open up a huge loophole in the law, as anyone could claim "but they SAID..." as a defence.

If you don't know how old someone is and they look young, even if you believe they're 18+, your default should be to assume that they are NOT old enough until you know otherwise for a fact. This applies in my job and for bar staff / bouncers so it should definitely apply when you're about to have sex with someone!

What do you think happens if someone walks into a bar and says "hello mate, can I have a pint? I'm 19." and the barman happily serves him? Do the authorities say "Well, that 12 year old looks older than he is and he SAID he was 19 so the poor barman was duped!"? No... Barman at the very least faces disciplinary action, and at worst could face prison time. Nothing happens to the 12 year old.

It has to be that way for a reason and that's sort of the point of being an adult; you have to stop being reckless in your actions, or you face the consequences.
