The Daleks are contractually obligated to appear in every series. The BBC don't own the rights to the Daleks.
But I agree with Dezzy, the RTD era did seriously overuse the Daleks. He brought them back over and over and wiped them out over and over. I like how Moffat brought them back in series 5 and let them live, while also keeping them in the background. Even with AotD, he left them to it.
