The New York DA had the tape that is currently being aired on TV of the actress clearly being coaxed into his room. At one point she comments on him touching her breast and he responds - I wont do it again. Seems like a bit of smoking gun to me and the actual story now is why didnt the DA prosecute him. That may be to do with the fact that actress in question had bit of a history.
