IIRC both, sort of, as both settled out of court for part of the royalties. I think both are undisclosed but it seems likely that Radiohead/Del Rey one was either over or exactly 40%, since it was known that they initially rejected an offer of 40% ... so if they did later settle, either they changed their minds on that figure or were offered more. I'd guess they got 50%.
Annoyingly of course, that means it's unknown how it would have gone if it had gone to court. Could literally have been awarded 100% of royalties, a split, or nothing at all . |

Hopefully sets precedent for future similar claims? I have a feeling that the other examples in the thread would probably have gone the same way IF anyone had been willing to let it go all the way to the courtroom. Seems like out-of-court settlements for a royalties %age have been the norm for this in the past.

I'm actually a huge fan of remixes, re-imaginings, covers and mash-ups in general so I genuinely want it not to be difficult for artists to draw on and use each other's work .
